PREAMBLE.
This website, accessible at the URLs maxstyle.it, www.maxstyle.it (hereinafter, the “Site”), is the exclusive property of Calzature Maxstyle Sas di Marzocchi Valeria & C., with registered office at Via O. Malagodi, 19/A-B, 44042 Cento (FE) – Italy, C.F./P. IVA 00397090382, REA: FE – 100477.
Access to and use of the Site, and browsing its pages, automatically confer User status and constitute full acceptance of these Terms of Use (the contractual terms governing use of the Site), as well as the General Terms and Conditions of Sale, the Privacy Policy and any other notice, legal notice, disclosure or disclaimer published anywhere on the Site, all of which are legally binding on visitors to the Site under Italian law.
In any event, this Site is not intended for persons under the age of 18.
Users who do not wish to accept any of the Terms of Use set out below are asked to leave the Site immediately.
The User undertakes to use the Site and any data, information or materials available on it exclusively for lawful purposes and in accordance with these Terms of Use. The User shall bear full responsibility for any unlawful use of the content and/or violation of any applicable law.
1. AMENDMENTS AND TERM OF THE SITE’S TERMS OF USE.
1.1. The content of these Terms of Use may be amended without prior notice at the discretion of Calzature Maxstyle Sas di Marzocchi Valeria & C.. Users are therefore required to review them regularly to stay informed of the applicable terms.
1.2. These Terms of Use, together with any subsequent amendments published on the Site, shall remain in full force and effect for as long as the User uses the Site and its related content, materials and/or services.
1.3. Even after use of the Site has ceased, the following provisions of these Terms shall remain in force and binding, as they are intended to survive:
a) exclusion and limitation of liability on the part of Calzature Maxstyle Sas di Marzocchi Valeria & C.;
b) the law applicable to the contract and its performance;
c) jurisdiction and competent court for any disputes.
2. PURPOSE OF THE WEBSITE.
2.1. The Website is for commercial purposes: through it, Calzature Maxstyle Sas di Marzocchi Valeria & C. intends to produce and sell food and non-food products, as well as make services available for booking, exclusively to consumers, meaning natural persons acting for purposes unrelated to any commercial, business, or professional activity they may carry out. Calzature Maxstyle Sas di Marzocchi Valeria & C. therefore reserves the right not to accept purchase order proposals submitted by Users who are not consumers, as well as any other purchase order proposal that does not comply with the General Terms and Conditions of Sale and these Terms of Use.
2.2. In any case, content published on the Website is not periodic in nature and therefore does not constitute an “editorial product” pursuant to and for the purposes of Law No. 62/2001.
3. WEBSITE INTERRUPTION AND SUSPENSION.
3.1. Calzature Maxstyle Sas di Marzocchi Valeria & C. reserves the right, at any time, to temporarily or permanently interrupt or suspend access to the website, individual pages, content, or services offered therein.
3.2. The User acknowledges that, with regard to such operations, Calzature Maxstyle Sas di Marzocchi Valeria & C. may in no way be held liable to the User or to third parties.
4. CONTENT, COPYRIGHT, TRADEMARKS AND DOMAIN NAMES.
4.1. The entire Website, including its constituent pages, ideas, graphic design, content, audio/video materials, and, more generally, any other creative work connected with the Website and its services, as well as certain food and non-food products made and sold through the Website, are the property of Calzature Maxstyle Sas di Marzocchi Valeria & C..
4.2. These materials may not be reproduced, used, or represented by the User, much less for unlawful purposes and/or those expressly prohibited by these Terms of Use, except in cases and within the limits expressly authorized by Calzature Maxstyle Sas di Marzocchi Valeria & C. or in cases and within the limits permitted by law.
4.3. Any use of the aforementioned trademarks that is unlawful or otherwise unauthorized is strictly prohibited. The use of these trademarks or any other distinctive sign appearing on the Website to improperly benefit from their distinctive character or reputation, or in a manner that harms them or their owners, is also prohibited.
4.4. The User is granted a non-transferable right to use the Website and/or services, limited to private, non-commercial use.
4.5. Calzature Maxstyle Sas di Marzocchi Valeria & C. undertakes to remove, as quickly as possible, content deemed unlawful and declared so by order of a Judicial Authority. Content considered unlawful at the sole discretion of Calzature Maxstyle Sas di Marzocchi Valeria & C., possibly reported by Users, will also be removed. In such cases, Calzature Maxstyle Sas di Marzocchi Valeria & C. will take the appropriate steps to notify the competent Authority.
4.6. If Calzature Maxstyle Sas di Marzocchi Valeria & C. discovers, either directly or following a report, a violation of the relevant national and/or international legislation, it reserves the right to suspend access to the Website or to specific content or materials.
5. USER OBLIGATIONS.
5.1. The User undertakes to use the Website and the services accessible through it diligently, in full compliance with Italian law, public morals, and these Terms of Use, as well as the General Terms and Conditions of Sale , the Privacy Policy and any other note, legal notice, disclosure, or disclaimer published anywhere on the Website.
5.2. All information provided by the User through any means for the purpose of obtaining the services offered by Calzature Maxstyle Sas di Marzocchi Valeria & C. must be truthful and complete. In any event, the User shall be solely responsible for any false and/or incomplete statements or information provided, as well as for any damage that may result to Calzature Maxstyle Sas di Marzocchi Valeria & C. or third parties.
5.3. The User may not, including but not limited to: use tools, software or scripts that are harmful to the Site or to the tools used by Calzature Maxstyle Sas di Marzocchi Valeria & C. (and its technicians) in providing its services; violate or attempt to alter any aspect of the Site’s services; block, overwrite, modify or copy unless necessary for the proper use of the Site’s services; reproduce using “robot/crawler”-type search technology; disclose or publicly reproduce Site content without prior authorization; alter Site data and content; take any action that may impair the functionality of the infrastructure of Calzature Maxstyle Sas di Marzocchi Valeria & C. or the Site; commit or facilitate a crime; disturb other Users; send unsolicited material, commonly known as “spam”; transmit and/or distribute viruses, trojans, worms, malware, logic bombs or any other material that is technologically harmful, violates confidentiality and privacy, or is in any way offensive or obscene; or infringe the property rights, including industrial and intellectual property rights, of any person.
6. ACCOUNT CREATION
6.1. To order and purchase products on the Site, the User can create a personal account by registering as follows:
a) click the stylized user icon in the menu bar at the top of any page on the Site;
b) then click the “shop” button if you wish to sign in with an account already registered on Shopify’s “Shop” platform;
c) alternatively, you can register your account on the Site by entering your email address and clicking “Continue”;
d) by clicking “Continue,” the User accepts these Terms of Use and the Privacy Policy;
e) the system will automatically send the User an email containing a temporary code, to be entered on the next page; by entering the code in the appropriate field and finally clicking “Submit,” the User will have registered the account associated with the email address.
6.2. For each subsequent account access, it will be sufficient to repeat the procedure, which also serves as a login.
6.3. Once the account creation process has been completed successfully, the registered User will also be able to access their personal area, which offers informational services such as:
a) track their orders;
b) view their order and purchase history;
c) view and change their contact and shipping information;
d) modify their login details;
e) request returns for purchased products.
6.4. In any case, please note that, as stated in the General Terms and Conditions of Sale, products may also be ordered and purchased on the Site without registering or using an account.
6.5. Users are advised that when accessing any area of the Site using a public computer (for example, an Internet café, public library, university classroom, etc.), they must carefully log out at the end of their session; otherwise, other users of the same device may be able to access the previously used account.
6.6. Furthermore, if access takes place from a mobile device (for example, a smartphone or tablet) through a web browser or an application, the account may remain logged in depending on the settings. Users are therefore advised to protect mobile devices with a password and, if the device is lost or stolen, to use the remote data deletion options (if available) to erase all personal information on the device, and finally to change the password for the account registered on the Site.
6.7. Registered Users may request deletion of their account at any time and for any reason by sending an email to support@maxstyle.it or through the other contact channels indicated on the Site; the User will receive confirmation that the account has been deleted.
6.8. The account must be used exclusively by the User and may not be transferred to third parties; the User agrees to ensure that no one else can access it and to immediately inform Calzature Maxstyle Sas di Marzocchi Valeria & C. if they suspect or become aware of any unauthorized access to or use of the account.
6.9. Each User may register only one personal account on the Site: multiple registrations are therefore expressly prohibited.
6.1. Calzature Maxstyle Sas di Marzocchi Valeria & C. reserves the right to delete a User’s account in the event of a breach of these Terms of Use, or if complete, truthful, and accurate personal data have not been provided, without prejudice to the right to compensation for any damage suffered.
6.2. As already specified in section 3.1 of these Terms of Use, Calzature Maxstyle Sas di Marzocchi Valeria & C. reserves the right, at any time, to temporarily or permanently interrupt or suspend access to the website, individual pages, content, or services offered on it, especially where security reasons arise.
7. LIMITATION OF LIABILITY.
7.1. The Site and its related services are provided “as is” and without any guarantee of operation.
7.2. The User acknowledges that use of the Site and access to its related services are at the User’s sole risk. In particular, Calzature Maxstyle Sas di Marzocchi Valeria & C. makes no specific warranties regarding any results expected, hoped for or obtained through use of the Site and access to its related services, and disclaims all liability for any claims by the User relating to use of, or malfunctions in, the Site or its services.
7.3. Calzature Maxstyle Sas di Marzocchi Valeria & C., including through its duly appointed external data processors, has adopted appropriate technical and organizational measures to protect the security and integrity of data relating to services, traffic and electronic communications, in order to prevent the risks of data and information being dispersed, destroyed or lost, as well as unauthorized or unlawful access to such data and information.
7.4. The User agrees and acknowledges that Calzature Maxstyle Sas di Marzocchi Valeria & C. shall not be deemed to have breached its obligations, nor be held liable for delays, malfunctions in the provision of the Site and related services, or for direct or indirect damages suffered by the User or third parties, arising from events beyond its reasonable and material control, including, by way of example only and without limitation:
a) failure and/or defective operation of services provided by telecommunications operators and/or electrical equipment and lines, as well as telephone, data and/or cyber connections, not directly managed by Calzature Maxstyle Sas di Marzocchi Valeria & C. or by persons for whom it is responsible;
b) malfunctioning of the User’s terminals or other communication systems;
c) actions by other users or other parties accessing the Network;
d) other events arising from unforeseeable circumstances and/or force majeure.
7.5. In the event of an interruption in the Site’s functionality, Calzature Maxstyle Sas di Marzocchi Valeria & C. undertakes to restore it as quickly as possible.
7.5. Calzature Maxstyle Sas di Marzocchi Valeria & C. takes every precaution to prevent content, images, videos, sounds, and graphic representations that describe or depict scenes or situations of physical or psychological violence, or that may in any way be considered offensive to people's dignity, freedom of expression, sexual or religious freedom, civil conditions, or human rights, from being published on the Site.
7.6. Calzature Maxstyle Sas di Marzocchi Valeria & C. also does not guarantee that the aforementioned content is appropriate or lawful in countries outside Italy. If the User encounters any of the above, they are asked not to access the Site. Nevertheless, should the User decide to access the Site and use the services offered, they do so solely under their own responsibility and by their own choice.
8. THIRD-PARTY WEBSITES AND CONTENT.
8.1. The Site may contain links to websites, content, and materials stored on third-party servers that are not monitored or controlled in any way by Calzature Maxstyle Sas di Marzocchi Valeria & C., and therefore, no liability is accepted for their content, accuracy, operation, legality, reliability, personal data processing policies, or other policies or disclosures.
8.2. The mere possibility of accessing such websites, content, and materials directly from the Site does not in itself imply their approval or sponsorship, and for these reasons, no responsibility is accepted for any type of loss, damage, or expense incurred by the User or third parties. Nor is any guarantee given that such websites, content, and materials are kept up to date.
8.3. By choosing to access third-party websites, content, and materials, the User acknowledges and agrees that these Terms of Use, as well as the General Terms and Conditions of Sale, the Privacy Policy, and any other note, legal notice, disclosure, or disclaimer published anywhere on the Site no longer apply to those third-party websites, content, and materials.
8.4. Calzature Maxstyle Sas di Marzocchi Valeria & C. strictly prohibits the use of meta tags and framing of its pages, that is, the embedding of a web page within another website in a way that prevents recognition of the authorship of the content. Links to the Site may be published only with written authorization from Calzature Maxstyle Sas di Marzocchi Valeria & C.
8.5. Calzature Maxstyle Sas di Marzocchi Valeria & C. reserves the right to take any action to protect its rights and legitimate interests if it suffers any financial or non-financial damage as a result of the conduct of the User or third parties, including, by way of example and without limitation, damage to its honor, reputation, or image.
9. PROTECTION OF PERSONAL DATA ON THE WEBSITE.
9.1. Users may access and browse the Website without revealing their identity or providing any personal data, except when ordering and purchasing products or booking services on the Website.
9.2. If the User wishes to receive information or be contacted by Calzature Maxstyle Sas di Marzocchi Valeria & C. through the specific contact form, they must provide certain personal data by filling it in. Before providing their personal data, the User is invited to read the Privacy Policy.
9.3. The User is asked to refrain from providing, via the contact form or by email, their personal data belonging to the special categories referred to in Article 9 of EU Regulation 2016/679 on the protection of personal data (“General Data Protection Regulation” – GDPR).
9.4. Calzature Maxstyle Sas di Marzocchi Valeria & C. declares that the processing of the User’s personal data, collected while browsing and using the Website’s services and features, will be and is carried out in full compliance with the obligations set out in EU Regulation 2016/679 and Legislative Decree 196/2003 (“Personal Data Protection Code”), in accordance with the methods and purposes specifically set out in the Privacy Policy, which the User acknowledges and declares to have specifically reviewed.
10. APPLICABLE LAW AND DISPUTE RESOLUTION.
10.1. These Terms of Use, as well as the General Terms and Conditions of Sale, the Privacy Policy and any other notice, legal notice, information notice, or disclaimer published anywhere on the Website, as well as the relationship between Calzature Maxstyle Sas di Marzocchi Valeria & C., the owner of the Website, and Users, are governed by Italian law.
10.2. Any disputes that may arise between Calzature Maxstyle Sas di Marzocchi Valeria & C. and Users, connected with or otherwise related to the use of this Website (and its content, materials, and services), as well as these Terms of Use, are subject to Italian jurisdiction and the exclusive territorial jurisdiction of the Court of Ferrara.
